This Health Data Privacy Notice describes how The Novel Tree (“we,” “us,” or “our”) collects, uses, shares, and protects consumer health data as defined by the Washington My Health My Data Act (MHMD). This Notice applies to Washington consumers and supplements our general Privacy Policy.

Consumer Health Data We Collect

We may collect the following categories of consumer health data:

  • Information related to cannabis purchases and transaction history

  • Information that may identify a consumer seeking cannabis products

  • Medical marijuana recognition card information, if applicable

  • Online activity related to cannabis products, including browsing behavior

  • Device and usage data when associated with cannabis-related interactions

Purpose of Collection

We collect consumer health data to:

  • Verify legal eligibility to purchase cannabis

  • Process and fulfill orders

  • Comply with state cannabis regulations

  • Provide customer support

  • Communicate with you where you have provided explicit consent

Categories of Health Data Shared

We may share consumer health data with the following categories of third parties, only where you have provided explicit consent or where required by law:

  • Payment processors

  • Point-of-sale and inventory management providers

  • Delivery and fulfillment partners

  • IT, security, and compliance vendors

Consumer Rights Under MHMD

You have the right to:

  • Confirm whether we collect, share, or sell your consumer health data

  • Request access to your consumer health data

  • Request deletion of your consumer health data

  • Withdraw consent for the collection or sharing of your consumer health data

  • Appeal a denied request

Geofencing

The Novel Tree does not use geofencing technology to identify or target consumers in or near cannabis dispensaries or other locations associated with health-related services.
